These Terms of Service ("Terms") constitute a legally binding agreement between you and SMS Jambo ("we," "us," or "our") governing your use of our bulk SMS services. By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

SMS Jambo provides a platform for sending bulk SMS messages. Our service allows you to manage contacts, create and schedule SMS campaigns, and track delivery status. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

2. User Obligations

By using SMS Jambo's services, you agree to:

• Provide accurate and up-to-date information during registration and maintain its accuracy
• Use the service in compliance with all applicable laws, regulations, and industry standards
• Obtain explicit consent from recipients before sending them messages
• Not use the service for any unlawful, abusive, or fraudulent purposes
• Not transmit any content that is unlawful, offensive, or infringes upon the rights of others
• Not transmit any content that is related to gambling of any kind unless a request for purchase of a unique senderID has been placed.
• Be solely responsible for the content of your messages and their compliance with applicable laws
• Indemnify and hold SMS Jambo harmless from any claims arising from your use of the service

3. Intellectual Property

All intellectual property rights related to SMS Jambo's services, including but not limited to software, trademarks, logos, and content, are owned by SMS Jambo. You are granted a limited, non-exclusive, non-transferable license to use our services. You may not use, reproduce, modify, or distribute any of our intellectual property without prior written consent.

4. Limitation of Liability

To the fullest extent permitted by law:

• SMS Jambo shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from the use or inability to use our services
• We do not guarantee the delivery, accuracy, timeliness, or reliability of messages sent through our platform
• Our total liability for any claims related to these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim

5. Termination

SMS Jambo reserves the right to suspend or terminate your access to the services at any time, with or without cause and without prior notice. Upon termination, all rights granted to you under these Terms will immediately cease.

6. Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the laws of Uganda. The arbitration shall take place in Mbarara, Uganda, and the language of arbitration shall be English.

7. Changes to the Terms

SMS Jambo may update or modify these Terms at any time without prior notice. The most current version will be posted on our website. Your continued use of the services after any modifications constitutes your acceptance of the revised Terms.

8. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

9. Entire Agreement

These Terms constitute the entire agreement between you and SMS Jambo regarding the use of our services, superseding any prior agreements.
